These Terms govern your access to and use of the Kurchu website, mobile applications, software services, CRM tools, AI features, and related business solutions.

Introduction

Welcome to Kurchu. By accessing or using Kurchu, you agree to be bound by these Terms. If you do not agree, you should not access or use our services. These Terms should be read together with our Privacy Policy.

Eligibility

You must be at least 18 years old, or the legal age required in your jurisdiction, to enter into a binding agreement. If you use Kurchu on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

Services We Provide

Kurchu may provide mobile application solutions, CRM systems, business management tools, AI-powered business features, automation tools, software development services, customer support services, and related technology solutions. Services may evolve over time as we improve and expand the platform.

User Accounts

You may be required to create an account to access certain services. You are responsible for maintaining account security, protecting login credentials, restricting unauthorized access, providing accurate information, and all activity that occurs under your account. Acceptable Use

You agree not to violate applicable laws, infringe intellectual property rights, upload malicious software, attempt unauthorized access, interfere with platform security, use Kurchu for fraudulent activities, abuse or disrupt services, or harass, threaten, or harm others. Kurchu may suspend or terminate accounts that violate these Terms.

Customer Data

Customers retain ownership of information they upload or create using Kurchu. You are responsible for ensuring you have lawful rights to the information you upload, that data collection complies with applicable laws, and that information does not violate third-party rights. AI Features

Kurchu may provide AI-powered functionality, including lead qualification, customer support assistance, workflow automation, business recommendations, and content generation. AI-generated outputs may contain inaccuracies or incomplete information. Users remain responsible for reviewing and validating important business decisions; AI features are intended to assist, not replace, human judgment.

Intellectual Property

All Kurchu software, branding, logos, designs, content, documentation, and platform technology remain the property of Kurchu unless otherwise stated. These Terms do not transfer ownership of intellectual property to users. You may not copy platform source code, reverse engineer software, redistribute proprietary materials, or create derivative works without permission.

Service Availability

We strive to maintain reliable services but do not guarantee uninterrupted availability. Services may be affected by maintenance, upgrades, security incidents, infrastructure failures, or third-party outages. Kurchu is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, internet or power outages, or government actions. Kurchu may modify, suspend, or discontinue services when necessary.

No Warranties

Kurchu services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Kurchu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be error-free, secure, or available without interruption.

Third-Party Services

Certain features may rely on third-party providers such as hosting providers, analytics providers, payment processors, communication services, and AI service providers. Use of those services may also be subject to their respective terms and policies.

Payments, Billing, and Refunds

Where paid services are offered, prices are displayed before purchase, fees are payable in the stated currency, and customers are responsible for applicable taxes. Failure to pay may result in suspension of services. Refund eligibility is governed by published refund policies and written agreements. Custom software development work may not be refundable once development has commenced.

Limitation of Liability and Indemnification

To the maximum extent permitted by law, Kurchu shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform, including loss of revenue, profits, business interruption, data loss, or lost opportunities. Total liability shall not exceed the amount paid by the customer to Kurchu during the preceding twelve months.

You agree to defend, indemnify, and hold harmless Kurchu and its team from claims, liabilities, damages, and expenses arising from your use of the platform, violation of these Terms, violation of applicable law, or infringement of third-party rights.

Dispute Resolution, Termination, and General Provisions

If a dispute arises, contact [email protected] first so we can try to resolve it directly. If a dispute cannot be resolved informally, it is subject to the exclusive jurisdiction of the courts located in Lahore, Pakistan, unless applicable law in your jurisdiction requires otherwise.

You may stop using Kurchu at any time. Kurchu may suspend or terminate accounts when these Terms are violated, fraud is suspected, security risks arise, or legal obligations require action. Certain provisions survive termination, including intellectual property, liability limitations, and dispute-related provisions.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kurchu regarding your use of our services. You may not assign these Terms without consent; Kurchu may assign them in connection with a merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver of our right to do so later.

Changes to These Terms

We may modify these Terms periodically. Updated versions will be posted on this page with a revised effective date. Continued use of Kurchu following updates constitutes acceptance of the revised Terms.
